Welcome to MZM Properties, a service provided by Zantana LLC. These Terms and Conditions ("Terms") govern your access to and use of our website, services, and any related applications (collectively, the "Services") for booking short-term rental accommodations. By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

1. Eligibility

To use the Services, you must be at least 18 years old and have the legal capacity to enter into contracts. By using the Platform, you represent and warrant that you meet these requirements.

2. User Accounts

  • Registration: To access certain features, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

  • Account Security: You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to protect your account.

3. Booking and Payment

  • Booking Process: Bookings are subject to availability and confirmation by the property host ("Host"). A booking is confirmed only when you receive a confirmation from the Platform.

  • Payment: You agree to pay all fees, including rental rates, service fees, taxes, and any additional charges (e.g., cleaning fees) as outlined during the booking process. Payments are processed securely through our designated payment processor.

  • Pricing: Prices are set by Hosts and may vary. We are not responsible for pricing errors but will make reasonable efforts to resolve disputes.

4. Cancellation and Refunds

  • Cancellation Policy: Cancellations are subject to the Host’s cancellation policy, which is displayed during the booking process. Refunds, if applicable, will be processed according to the policy selected at booking.

  • Platform Fees: Service fees charged by the Platform are non-refundable unless otherwise stated.

  • No-Show: Failure to arrive at the property without prior cancellation may result in forfeiture of the full booking amount.

5. Guest Responsibilities

  • Property Use: You agree to use the rented property respectfully and in accordance with the Host’s rules, local laws, and these Terms. You are responsible for any damage caused by you or your guests during your stay.

  • Prohibited Activities: You may not use the property for illegal activities, parties, or any purpose other than residential use unless explicitly permitted by the Host.

  • Check-In/Check-Out: You must adhere to the check-in and check-out times specified by the Host unless otherwise agreed.

6. Host Responsibilities

  • Accuracy: Hosts must provide accurate and up-to-date information about their property, including availability, amenities, and pricing.

  • Compliance: Hosts are responsible for complying with all applicable laws, including zoning, tax, and safety regulations.

7. Platform’s Role

  • Facilitator: We act as an intermediary between Guests and Hosts. We do not own, manage, or control the properties listed on the Platform.

  • No Guarantee: We do not guarantee the accuracy of listings, the condition of properties, or the performance of Hosts or Guests. Users are responsible for verifying information before booking.

8. Liability and Disclaimers

  • Limitation of Liability: To the fullest extent permitted by law, MZM Properties is not liable for any direct, indirect, incidental, or consequential damages arising from your use of the Services, including but not limited to property damage, personal injury, or booking disputes.

  • Third-Party Services: The Platform may integrate third-party services (e.g., payment processors). We are not responsible for the performance or policies of these third parties.

  • As-Is Basis: The Services are provided "as is" without warranties of any kind, express or implied.

9. User Conduct

  • You agree not to:

    • Violate any laws or regulations.

    • Post false, misleading, or defamatory content.

    • Interfere with the Platform’s functionality or security.

    • Use the Platform for commercial purposes without our consent.

10. Intellectual Property

All content on the Platform, including text, images, logos, and software, is owned by or licensed to Zantana LLC. You may not reproduce, distribute, or modify this content without our prior written consent.

11. Termination

We reserve the right to suspend or terminate your access to the Services at our discretion, including for violations of these Terms or suspected fraudulent activity.

12. Dispute Resolution

  • Informal Resolution: If a dispute arises, you agree to contact us first to attempt to resolve it informally.

  • Governing Law: These Terms are governed by the laws of Texas, USA. Any disputes not resolved informally will be handled in the courts of Texas, USA.

  • Arbitration: Any disputes not resolved informally may be subject to binding arbitration, as determined by Zantana LLC, in accordance with [e.g., the rules of the American Arbitration Association].

13. Modifications to Terms

We may update these Terms at any time. Changes will be posted on the Platform, and continued use of the Services constitutes acceptance of the updated Terms.
